1. Acceptance of Terms

By accessing and using the JWCO application ("Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Description of Service

JWCO provides workforce management services including but not limited to project management, time tracking, payroll processing, crew management, and communication tools. Our Service includes automated email and SMS notifications to facilitate business operations.

3. User Accounts and Registration

To access certain features of our Service, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

Registration Requirements

During registration, you must provide:

  • A valid email address and phone number
  • Your legal name as it appears on official documents
  • A valid registration code provided by your employer
  • Your Social Security Number for employment verification and tax purposes
  • Accurate pay rate information as authorized by your employer
  • A secure password meeting our security requirements

Data Accuracy and Responsibility

You acknowledge that providing false, inaccurate, or incomplete information during registration may result in:

  • Inability to process payroll correctly
  • Tax reporting errors
  • Employment verification issues
  • Immediate suspension or termination of your account
  • Legal consequences for providing fraudulent information

Account Security

You are responsible for safeguarding the password and for maintaining the confidentiality of your account. You agree not to disclose your password to any third party and to take sole responsibility for activities that occur under your account.

You must notify us immediately of any unauthorized use of your account or any other breach of security.

4. Email and SMS Communications

By using our Service, you consent to receive communications from us via email and SMS text messages. These communications may include:

  • Account notifications and security alerts
  • System updates and maintenance notifications
  • Work assignments and schedule updates
  • Payroll and timesheet notifications
  • Project updates and status changes
  • Administrative messages related to your employment or contractor status

You may opt out of non-essential communications at any time by contacting your administrator or updating your notification preferences in your account settings. However, you cannot opt out of essential service-related communications necessary for the operation of your account.

Standard message and data rates may apply for SMS communications. We are not responsible for any charges incurred from your mobile carrier.

5. Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

6. User Conduct

You agree not to use the Service to:

  • Violate any applicable local, state, national, or international law or regulation
  • Transmit, or procure the sending of, any advertising or promotional material, including any "junk mail," "chain letter," "spam," or any other similar solicitation
  • Impersonate or attempt to impersonate the Company, a Company employee, another user, or any other person or entity
  • Engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Service

7. Intellectual Property Rights

The Service and its original content, features, and functionality are and will remain the exclusive property of JWCO and its licensors. The Service is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

8. Time Tracking and Payroll

Users are responsible for accurately recording their time and work activities through the Service. False or fraudulent time entries may result in immediate termination of access to the Service and may be subject to legal action.

Payroll processing is subject to company policies and applicable employment laws. The Service facilitates payroll management but does not guarantee payment timing or amounts.

9. Data Accuracy and Reliability

While we strive to ensure the accuracy and reliability of the information and data within our Service, we do not guarantee that all information is error-free. Users should verify critical information independently.

10. Service Availability

We strive to maintain Service availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

11. Limitation of Liability

In no event shall JWCO, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of the Service.

12. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

If you wish to terminate your account, you may simply discontinue using the Service or contact your administrator.

13. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect.

14. Governing Law

These Terms shall be interpreted and governed by the laws of the jurisdiction in which JWCO operates, without regard to its conflict of law provisions.
